  1. This is a LEGAL AGREEMENT made between you the user and Stockbyte<TM>, and governs
  2. how you may use the images and data contained in this Comping CD.
  3.  
  4. In CONSIDERATION of Stockbyte<TM> allowing you to use the CD, in the manner permitted
  5. by this Agreement, YOU AGREE TO BECOME BOUND BY THE FOLLOWING TERMS AND CONDITIONS
  6.  
  7. 1.    You accept that all copyrights and all rights of a proprietary nature and 
  8. title to and in the photographic images and data are the property of Stockbyte<TM>.  
  9. Use conferred by this CD and strictly limited by the terms of this Agreement, does 
  10. not in any way confer any property copyright or proprietary rights on you the user.
  11.  
  12. 1.1    You may only use the photographic images and data in the following ways
  13.     *    to view the images
  14.     *    to create documents for client approval
  15.     
  16. 1.2    You may not use the photographic images or data in the following ways
  17.     *    to produce colour separations
  18.     *    to produce or compile CD ROM materials
  19.     *    to produce any multimedia output, materials or documentation
  20.     *    to produce any other electronic or printed output, materials or 
  21.         production
  22.     
  23. 1.3    You may not use the photographic images and data in such a way as to alter, add 
  24.     to, insert, impose or in any other way distort, amend or use the photographic 
  25.     images or data in any form other than in the form originally contained on this CD.

  27. 1.4    It is STRICTLY PROHIBITED to use the photographic images in any way which could 
  28.     be regarded as obscene, derogatory, defamatory blasphemous or pornographic.
  29.  
  30. 1.5    The user accepts that the limited licence to use the photographic works conferred 
  31.     by this Agreement is non transferrable to other parties.
  32.  
  33. 1.6    The user shall indemnify and keep indemnified Stockbyte<TM> from all and any actions, 
  34.     proceedings, claims, demands, costs including legal costs awards or damages arising 
  35.     either directly or indirectly as a result of the use or misuse of the photographic 
  36.     images and data on this CD, and or arising as a result of the breach of any terms 
  37.     of this Agreement by this user, no matter where such claims, demands or proceedings 
  38.     arise.

  40. 1.7    Stockbyte<TM> supplies the Sample CD as is, and does not accept any responsibility 
  41.     or liability for any loss or damage, direct or indirect, consequential or incidental 
  42.     arising out of the inability to use the photographic images or data.
  43.  
  44. 1.8    The provisions of this Agreement shall be governed by and construed in accordance 
  45.     with the laws of the Republic of Ireland, whose Courts will be the Courts of sole 
  46.     jurisdiction in relation to this Agreement.

  48. 2    Warranties of the Licensee
  49.  
  50. The Licensee accepts and warrants that use of the photograph images and data  shall not 
  51. infringe any third party rights, of any nature, and any liability for the infringement of 
  52. third party rights, of whatsoever nature, shall rest with the Licensee.
  53. Prepress companies may not make Stockbyte<TM> images available to their customers, or 
  54. advertise the availability of Stockbyte<TM> images without the purchase of a bureau licence 
  55. from Stockbyte<TM>.

  57. using any images.
